Understanding Real Estate Professional Status (REPS)

What is the 750-Hour Rule?

To qualify for Real Estate Professional Status under IRS rules, you must spend more than 750 hours per year in real property trades or businesses. Additionally, this time must represent more than 50% of your total personal services performed during the year. Meeting these requirements allows you to deduct rental property losses against your ordinary income, potentially saving thousands in taxes.

What Counts as Material Participation?

Material participation means you're involved in your rental property operations on a regular, continuous, and substantial basis. Qualifying activities include:

The STR Loophole: Short-Term Rental Material Participation

Short-term rentals (STRs) with an average rental period of 7 days or less can qualify for material participation under a separate test — without needing full REPS status. Under the 100-hour test, you must participate at least 100 hours per year in the rental activity, and no one else (including contractors or property managers) can participate more hours than you. This "STR loophole" is perfect for high-income W-2 earners who can't meet the 750-hour REPS requirement but still want to deduct rental losses.
